OCR Issues New Guidance on Transgender Student Complaints

Recently the Acting Assistant Secretary for Civil Rights for the U.S. Department of Education, sent OCR Regional Directors a memorandum outlining the evaluation and investigation of complaints by transgender students.

 The guidance declares that OCR offices can no longer rely on the May 2016 Dear Colleague Letter (or the predecessor 2015 private letter) concerning transgender students' rights under Title IX as a basis for resolving a complaint. Instead OCR must apply Title IX and its implementing regulations as interpreted by the federal courts in evaluating a complaint of sex discrimination.

 The directive lists the following allegations as those over which OCR has continuing jurisdiction:

  • Failure to resolve promptly and equitably a transgender student's complaint of sex discrimination;
  • Failure to assess whether sexual harassment or gender-based harassment of a transgender student has created a hostile environment;
  • Failure to take steps reasonably calculated to address harassment that creates a hostile environment;
  • Retaliation against a transgender student who has raised concerns about possible sex discrimination; and
  • Different treatment based on sex stereotyping.

The document instructs field offices to evaluate separately each allegation of a complaint. Before proceeding to investigate any allegation, OCR must determine that it contains sufficient information to move forward.

WALT ZUKOWSKI RE-APPOINTED TO EDUCATION COUNCIL

Russell W. Hartigan, President of the Illinois State Bar Association, recently re-appointed Walt Zukowski as a member of the ISBA Council for Education Law.  This group of 15 lawyers from across the State work towards addressing issues particular to public education: new cases and legislation, as well as continuing education.

 

Walt Zukowski is the founder and Senior Attorney in Zukowski Law Offices, in Peru, Illinois. The Firm also does extensive work in corporate representation, with an emphasis on public schools as well as private business entities.   

 

Mr. Zukowski is an active author and lecturer in various legal fields.  He served as Chair of the Education Law Section Council in 2013-14.  

 

Mr. Zukowski is a summa cum laude graduate of IVCC and University of Illinois–Springfield. He has a Juris Doctorate and Masters of Business Administration, with honors, from the University of Notre Dame.

 

Mr. Zukowski and his wife Nancy reside in Peru.

Walt Zukowski is the founder and Senior Attorney in Zukowski Law Offices, in Peru, Illinois.  The Firm is involved in specialized areas of Estate Planning, Wills, Trusts, and Estates.  The Firm also does extensive work in corporate representation, with an emphasis on public and private schools as well as private business entities and real estate. 

 

Mr. Zukowski is an active author and lecturer in various legal fields.  He first served as a member of the Elder Law Section Council in 2002.
